FNLD GRVL 2025 Event Participant Waiver
PARTICIPANT’S RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
READ CAREFULLY BEFORE SIGNING
BY SIGNING THIS RELEASE AGREEMENT YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION.
In consideration for my being permitted to participate in the EU GRVL Holdings, LLC d/b/a FNLD GRVL event, I, for myself, my spouse, children, guardians, heirs and next of kin, agree to the following Release of Liability, Assumption of Risk and Indemnity Agreement. Certain risks are inherent in any recreational activity and cannot be eliminated or reduced. The same inherent risks that contribute to the unique character of the activity can be the cause of damage to the equipment associated with the activity, or injury, illness, paralysis or death. I understand and acknowledge that there are risks, hazards and dangers that are inherent and integral to these activities. I understand that I may walk away from entering such activities if the Release form herein is not agreed upon;
I am aware that participating in a gravel cycling event is a hazardous activity, and that I am voluntarily participating in this activity with the knowledge of the dangers involved and I hereby agree to accept, and I do hereby assume, any and all risks of injury and death.
I UNDERSTAND THAT THESE INHERENT RISKS, HAZARDS AND DANGERS INCLUDE, WITHOUT LIMITATION:
Risks involved in gravel cycling generally. These risks include without limitation areas where objects are not marked and hazards may not be visible; where vehicular traffic may be present; where roads or trails are not groomed, maintained, or controlled, and surface hazards, loose surfaces, or potholes might exist; where weather is unpredictable, changeable and dangerous; and where lightning, thunder, bee hives, animals, and other natural hazards and dangers exist;
Risks arising out of any activity involving bicycles which are unpredictable and uncontrollable in all circumstances, and which involve equipment that may break or otherwise fail, and other participants who may fail to control their bicycles and cause a collision or other unpredictable consequences;
Risks involved in event organizer decision making and conduct including, without limitation, route selection, location of feed zones or other support stations, and conduct of event volunteers and staff;
Risks arising out of participant equipment malfunction;
Risks arising out of my own medical conditions, if any, and cycling ability level. By signing this Release Agreement I represent that I am in good health and proper physical condition, and have adequate bicycle handling skills, to safely participate in a mass-participation gravel cycling event; and
Such other risks, hazards and dangers that are integral to recreational activities offered and engaged in, in a mass-participation gravel cycling event.
Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,
I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS (insert name of sports organization) their officers, officials, partners, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
WARNING
I acknowledge that the above description of inherent risks is not complete and that there are other risks, hazards and dangers associated with participating in a mass-participation gravel cycling event, that be unknown or unanticipated. The inherent and other risks, hazards and dangers may result in damage to equipment or injury, illness, paralysis or death. I acknowledge that EU GRVL Holdings, LLC d/b/a FNLD GRVL has been available to more fully explain to me the risks of these activities.
I understand that I have responsibilities as a participant in these activities. There are no mental or physical problems or limitations associated with my participation in the recreational activities which I have not disclosed in writing to EU GRVL Holdings, LLC d/b/a FNLD GRVL. I am fully capable of participating in all of these activities. I understand that the presence of EU GRVL Holdings, LLC d/b/a FNLD GRVL personnel, volunteers, and medical staff, is no assurance of my safety or the lessening of any of these risks. I am voluntarily participating in this mass-participation gravel cycling event with full knowledge of the risks, hazards and dangers involved and hereby assume and accept any and all risks of damages, injury, illness, paralysis or death. I agree to be familiar with and abide by the rules and regulations established by EU GRVL Holdings, LLC d/b/a FNLD GRVL for this event. I agree to ride and participate so as to neither endanger myself nor others. I will wear a CPSC-compliant helmet. I acknowledge that EU GRVL Holdings, LLC d/b/a FNLD GRVL is applying UCI Anti-Doping Rules and USADA Protocol to this event. I agree to submit to drug testing and understand that the use of methods or substances prohibited by the applicable anti-doping rules would make me subject to penalties up to disqualification, suspension, and forfeiture of prize money.
I acknowledge such risks may otherwise result in claims against EU GRVL Holdings, LLC d/b/a FNLD GRVL, however:
I, for myself, my heirs, successors, executors and subrogors, hereby knowingly and intentionally waive and release, indemnify and hold harmless EU GRVL Holdings, LLC d/b/a FNLD GRVL, its owners, agents and employees, with respect to any and all claims, actions, causes of nature, whether foreseen or unforeseen, arising directly or indirectly out of any damages, loss, injury, paralysis or death to me or my property in any way connected with my participation in this mass-participation gravel cycling event. I agree that neither I, nor anyone acting on my behalf, will make a claim of any kind against EU GRVL Holdings, LLC d/b/a FNLD GRVL as a result of any damage, injury, paralysis or death to me or my property.
I agree that all documents and all other aspects of my relationship with EU GRVL Holdings, LLC d/b/a FNLD GRVL are governed by the laws of the State of Colorado. Further, any suit, legal proceeding, mediation or arbitration arising out of or relating to my participation in this mass-participation gravel cycling event, or any other dispute with EU GRVL Holdings, LLC d/b/a FNLD GRVL, must be filed exclusively in the State of Colorado and Colorado law shall be determinative. If any provision, term or condition of this agreement shall be judicially determined to be invalid, the other portions of the agreement shall nevertheless continue in full force and effect. I understand this Release, Waiver and Indemnity Agreement is the entire agreement with EU GRVL Holdings, LLC d/b/a FNLD GRVL and that this agreement cannot be modified or changed in any way by the representations or statements of any directors, officers, agents, and/or employees, or by the client.
Medical Treatment. I agree to abide by any decision by an Event official relative to my ability to safely complete the
Event. I further consent to administration of first aid and/or other medical treatment in the event of injury or illness and hereby release and indemnify Releasees from any and all liability or claims arising out of such treatment. I understand that any and all costs resulting from any medical attention and/or treatment that I receive shall be solely my responsibility and the Releasees shall in no way be liable or responsible for any of these costs.
Force Majeure; Refunds. The Releasees reserve the right, in their sole and absolute discretion, to postpone, cancel, or modify the event due to weather conditions, Acts of God or other factors beyond the control of the Releasees that might affect the health and/or safety of the participants. I also understand the following refund policy should the Event be postponed, canceled or otherwise modified:
90+ days out – 70% refund
60-89 days out – 50% refund
30-59 days out – 40% refund
Transgender policy: FNLD GRVL’s policy allows any competitor to register for an entry as the gender with which the competitor identifies. If that gender is different from the gender reflected on the competitor’s birth certificate or is a different gender from that previously used by the competitor at a cycling or competitive sporting event and a complaint is filed, the competitor must provide to FNLD GRVL an objective manifestation upon request (documentation or other evidence) that shows the stated gender is sincerely held and reflects the person’s core identity. Documentation satisfying this standard generally may include, without limitation, government-issued documentation or documentation prepared by a health care provider or licensed counselor. The health care provider or licensed counselor must not be the athlete’s first or second-degree relative.
Media Release; No Compensation. I irrevocably grant unlimited permission to Releasees, to use, reproduce, sell and distribute any and all photographs, images, videotapes, motion pictures, video and audio recordings, or any other depiction of any kind of me or of my participation in the Event or related activity for any legitimate purpose in perpetuity and I understand that I shall not be entitled to any compensation therefore. Furthermore, I hereby irrevocably and absolutely grant permission to the Releasees to film, videotape and record gratis my performance in the Event and subsequently to telecast, sell, distribute and otherwise utilize the same in whatever manner Releasees shall deem appropriate. Such permission shall include granting the unlimited and irrevocable right to Releasees, without compensation of any kind to me, to use, reproduce or broadcast, my name, nickname, image, likeness, voice, photograph, signature facsimile, and biographical information in connection with the Event without compensation of any kind to me. I acknowledge that Releasees and their representatives shall have the unlimited right throughout the world to copyright, use, reuse, publish, republish, broadcast and otherwise distribute depictions of or information about me and all or any portion of the Event in which I may appear on any and all radio, network, cable and local television programs and in any print materials and in any other format or media (including electronic media) now known or hereinafter devised in perpetuity and without compensation to me. In consideration and in return for being allowed to participate in the Event, I release and agree not to sue the Releasees from all present and future claims regarding my participation in the Events that may be made by me, my family, estate heirs, or assigns.
I have carefully read, clearly understood and voluntarily signed this Release of Liability, Assumption of Risk & Indemnity Agreement. I attest that I am 18 years of age or older.

PARENTAL/LEGAL GUARDIAN CONSENT
I attest that I am the parent or legal guardian of the minor participant named above. I have carefully read the foregoing and agree to all of the terms.
Minors Under the Age of 18. In the case that the participant of the above Release (the "Participant") is under the age of 18, I hereby certify, warrant and represent that I am the legal parent or guardian of said Participant. Furthermore, after fully informing myself regarding the nature and risks of the Event, I give my permission for Participant to participate in the same. Furthermore, I fully ratify, accept and agree to all of the terms of the above Release both for myself individually and as legal parent or guardian of the Participant.
